Terms of Service

1. Acceptance of Terms

By accessing or using Flirp ("the Service"), including any applications, features, or tools offered through flirp.app (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Flirp provides free web-based tools, calculators, and applications. Certain features, including Stake My Sweat, involve voluntary financial commitments where users authorize potential charges to their saved payment method based on self-reported activity.

3. Stake My Sweat — Financial Commitment Terms

3.1 Voluntary Participation. Stake My Sweat is entirely voluntary. By creating a commitment, you acknowledge that you are choosing to place a financial stake on your own fitness goal. You are not required to use this feature.

3.2 How It Works. You set a workout goal and stake an amount of money. Your payment method is saved via Stripe. If you meet your goal within the commitment period, your card is never charged. If you fail to meet your goal, the full staked amount is charged to your saved payment method. There is no partial charging.

3.3 Self-Reported Check-Ins. Workout check-ins are self-reported. Flirp does not verify whether a workout actually occurred. You are solely responsible for the accuracy of your check-ins. Flirp is not liable for charges resulting from failure to check in, forgotten check-ins, technical issues preventing check-in, or any other reason.

3.4 Recurring Commitments. If you enable auto-renewal, a new commitment with the same settings is automatically created when your current commitment ends. You may cancel auto-renewal or pause it at any time before the current commitment expires. Flirp is not responsible for charges on auto-renewed commitments you forgot to cancel.

3.5 Charges Are Final. If you fail to meet your goal, the charge to your payment method is final. By creating a commitment, you expressly authorize Flirp to charge the staked amount to your saved payment method upon failure to meet your stated goal. This is the core mechanic of the feature and not a penalty — it is the motivational mechanism you opted into.

3.6 Refund Requests. You may submit a refund request within 7 days of a commitment's expiration date. Refund requests are reviewed at Flirp's sole discretion. Flirp is under no obligation to approve any refund request. Approved refunds are processed back to the original payment method and may take 5–10 business days to appear.

3.7 Failed Charges. If a charge fails (e.g., expired card, insufficient funds), Flirp may retry the charge up to 3 times. You remain liable for the staked amount regardless of payment method issues.

3.8 No Guarantee of Results. Flirp makes no guarantees about fitness outcomes, health benefits, or motivational effectiveness. The Service is a self-accountability tool, not a fitness program, medical device, or health service.

4. User Accounts

You may sign in using Google OAuth. You are responsible for maintaining the security of your account. You agree to provide accurate information and to not create accounts on behalf of others without their permission.

5. Payment Processing

All payment processing is handled by Stripe, Inc. Flirp does not store your credit card number or sensitive payment details. By saving a payment method, you agree to Stripe's Terms of Service.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FLIRP DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. FLIRP DOES NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION PROVIDED THROUGH THE SERVICE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLIRP AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. IN NO EVENT SHALL FLIRP'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO FLIRP IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless Flirp and its owners, operators, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

9. Assumption of Risk

You acknowledge that using Stake My Sweat involves the risk of financial loss. You voluntarily assume all risks associated with your use of the Service, including but not limited to the risk of being charged for failing to meet your self-set goals. You acknowledge that Flirp is not responsible for any financial loss you incur as a result of using the Service.

10. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to manipulate, exploit, or abuse the check-in system
  • Interfere with or disrupt the Service or its underlying infrastructure
  • Create multiple accounts to circumvent limitations or abuse features
  • Initiate chargebacks or payment disputes in bad faith for charges you authorized

11. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in a class action lawsuit. The arbitration shall take place in the jurisdiction where Flirp operates, and the decision of the arbitrator shall be final and binding.

12. Modifications

Flirp reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated through the Site.

13. Termination

Flirp may suspend or terminate your access to the Service at any time, for any reason, without notice. Upon termination, any active commitments remain binding per their original terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any legal proceedings shall be conducted in English.
